Frequently asked questions from Brookfield clients

How do I resolve a commercial lease dispute in Waukesha County?

Start by reviewing the lease’s breach provisions, cure periods, and mitigation clauses. If direct negotiation fails, commercial litigation can protect your business from unlawful eviction or financial damages.

Obtain a certified survey, review recorded historical deeds, and, if needed, use a quiet title action to resolve the conflicting claims.

Under Wisconsin Statutes Chapter 779, subcontractors and suppliers generally must give the owner a written notice of lien rights within 60 days after first furnishing labor or materials. They must then serve a 30-day notice of intent before filing. The lien claim must be filed with the Waukesha County Clerk of Circuit Court within 6 months after the last labor or materials were furnished. Missing a deadline can void the lien.

Assets held solely in the deceased person’s name with no beneficiary designation. Assets with transfer-on-death or payable-on-death designations, or held jointly with survivorship, usually avoid probate.
